Please read these Terms of Service ("Terms") carefully before using Rize. By creating an account or using the app, you agree to these Terms. If you do not agree, do not use the app.
1. Who we are
Rize ("Rize," "we," "us") is a mobile workout app operated by an independent developer. You can reach us at chananelben@gmail.com.
2. Acceptance of terms
By downloading, installing, or using Rize, you confirm that:
- You have read and agree to these Terms.
- You have read and agree to our Privacy Policy.
- You are at least 13 years old, or the minimum digital consent age in your country if that age is higher.
If you do not agree, stop using the app and delete it from your device.
3. Medical disclaimer (please read this)
Exercise can be strenuous and can cause injury or, in rare cases, death. Before starting any new exercise program, or before pushing into higher heart-rate zones, you should consult a qualified medical professional, especially if you:
- Have a heart condition or have had a heart event.
- Have high blood pressure, diabetes, or any chronic illness.
- Are pregnant.
- Are recovering from surgery or injury.
- Are over 40 and have not exercised in a long time.
- Feel pain, dizziness, shortness of breath, or any other unusual symptom during exercise.
The five heart-rate zones Rize uses are estimates derived from a simple age-based formula (220 minus age). They are not personalized medical thresholds. Stop exercising immediately if you feel unwell. You exercise at your own risk.
4. Your account
To use Rize you need an account. You agree to:
- Provide accurate information (email, age, biological sex) and keep it current.
- Maintain only one account per person.
- Keep your login credentials secure.
- Notify us at chananelben@gmail.com if you suspect unauthorized access.
You are responsible for all activity on your account.
5. Third-party services
Rize depends on services we do not operate. Your use of those services is governed by their own terms.
5.1 Apple Music
Rize controls playback; Apple Music plays the music. You need an active Apple Music subscription, governed by Apple's terms. We are not responsible for Apple Music outages, catalog changes, song unavailability, or charges to your Apple ID.
5.2 Strava (optional)
If you link a Strava account, finished workouts are uploaded there under Strava's own terms. Disconnecting Strava stops future uploads. Workouts already on Strava are managed inside Strava.
5.3 Heart-rate hardware (Apple Watch, Garmin, BLE chest straps, etc.)
Rize reads data from third-party hardware. We are not the manufacturer. We do not warrant the accuracy of any heart-rate reading, GPS coordinate, or sensor output. Sensor accuracy varies by device, fit, sweat, electromagnetic interference, and other factors. Treat all readings as approximate.
5.4 BPM lookup providers
We use Deezer, MusicBrainz, and GetSongBPM to look up song tempos. We do not control their data and do not guarantee any song is mapped to the correct zone. You can manually re-map any song inside the app.
6. Acceptable use
You agree not to:
- Reverse engineer, decompile, or attempt to extract source code from the app, except where this restriction is prohibited by law.
- Use the app to harass, harm, or impersonate any person.
- Probe, scan, or attack our servers or any third-party service the app depends on.
- Use the app in a way that violates any law, regulation, or third-party right.
- Use the app to build a competing product or service.
- Bypass usage limits, authentication, or any technical measure that restricts the app.
We may suspend or terminate your account if you violate these rules.
7. Intellectual property
Rize — including the app, brand, logo, screens, code, and design — is owned by the developer and is protected by copyright and other intellectual-property laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the app on devices you own or control, solely for your own non-commercial use.
You retain ownership of your data (workouts, profile, etc.). By using the app you grant us a limited license to store, process, and display that data so the app can function.
Music streamed via Apple Music belongs to its respective rights holders. Rize does not own, license, or redistribute music.
8. Beta features and changes
Rize is evolving. Features may change, break, or be removed at any time. We may roll out beta features that may not work as expected. We may also update these Terms; if we do, we will update the "Effective date" and notify you in-app. Continued use after a change means you accept the updated Terms.
9. Termination
You may delete your account at any time by emailing chananelben@gmail.com. We may suspend or terminate your account if you violate these Terms, if required by law, or if continuing to provide the service becomes impractical. On termination, your right to use the app ends immediately; provisions that by their nature should survive (e.g., disclaimers, limitation of liability) will survive.
10. Disclaimer of warranties
The app is provided "as is" and "as available", without warranty of any kind, express or implied — including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that the app will be uninterrupted, error-free, secure, or accurate.
You are responsible for any consequences of acting on information the app provides.
11. Limitation of liability
To the maximum extent permitted by law, Rize and its developer will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, or personal injury, arising out of or related to your use of the app — even if we have been advised of the possibility of such damages.
Our total aggregate liability for any claim arising out of or related to the app will not exceed the greater of (a) the amount you have paid us in the twelve months before the claim or (b) ten US dollars (USD 10).
Some jurisdictions do not allow these limitations; in those jurisdictions, the limitations apply only to the extent permitted by law.
12. Indemnification
You agree to indemnify and hold Rize and its developer harmless from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of your use of the app, your violation of these Terms, or your violation of any third-party right.
13. Governing law
These Terms are governed by the laws of the jurisdiction in which the developer resides, without regard to its conflict-of-law rules. (Specific jurisdiction to be confirmed by the developer before public launch.) You and Rize agree to submit to the exclusive jurisdiction of the courts in that jurisdiction for any dispute arising out of or related to the app, except where applicable consumer-protection law requires otherwise.
14. Apple-specific terms (App Store)
If you obtained Rize from the Apple App Store, the following also applies:
- These Terms are between you and Rize, not Apple. Apple is not responsible for the app or its content.
- Apple has no obligation to provide maintenance or support for the app.
- In case of any failure to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
- Apple is not responsible for addressing any claims by you or any third party relating to the app, including product liability claims, claims that the app fails to conform to any legal or regulatory requirement, and claims under consumer-protection or similar legislation.
- Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, will have the right to enforce these Terms against you.
